good morning. >> reporter: good morning. first i want to point out when we drove up to the neighborhood i was surprised to see where this attempted kidnapping happened. we are in a tight knit cul-de-sac. this is where it all went down. the suspect walked up to this particular house over my shoulder here and made inappropriate comment to the 2-year-old girl playing in her own front yard. the mother fortunately was watching. she didn't like what she heard. she picked up her little girl and police say the man walked up and tried to wrestle the girl away from her mother's arms. he was not successful. the mother put up a good fight. ran inside to call police. the man took off on foot. i hung up the phone with the san jose police spokesman this morning. he tells me they are giving the mom space to regroup before they grill her with questions today

simply because she's so shook up. >> she did what she had to do. it was her child. i think we all fight that much harder. but kudos to her. i'm glad she's home safely now with her child. that's the best we can ask for. on the same note we need to get this guy off the streets. >> reporter: police say the suspect is hispanic between 20 and 30 years old, wearing a red baseball hat, jeans and a light-colored or white striped shirt. here is one detail the woman gave police. he smelled like automotive oil. the officer said when i asked him, the mother said she's never seen this man in this neighborhood before. of course if you have any information about this case, you're asked to call san jose police. live in the san jose, marla teyes, "today in the bay." >> questions remain as to

whether or not a controversial police leader will be brought in to help oakland fight crime. after hours of heated debate the safety committee votes yes to get extra help. no to bill bratton. kristy smith is live at oakland police headquarters with more for us. good morning, kristy? >> good morning, john. oakland has seen a spike in violent crime. six homicides this year so far. in fact, last friday there were four homicides in ten hours. the city is looking at a plan to bring in an outside consultant to bring the crime rate down. that's sparked a lively and heated debate. just last night, hundreds of people packed into a public safety committee often getting loud and booing police chief jordan, stopping him from explaining why he supports a plan to spend $250,000 to pay former police chief bill bratton to give advice on how to stop crime in oakland. he worked in new york and had success in l.a. as well. opponents say bratton won't help

but will rely on policies like stop and frisk, things they say lead to racial profiling. they say jordan doesn't need that. >> if you need to hear what he has to say, why don't you have jordan buy the book on amazon? >> some in the crowd supported bratton but they were drowned out by the larger crowd. chief jordan said he supports the plan to hire bratton. he won't put civil lib 'tis and public trust in jeopardy. the committee voted to recommend a contract hire doesn't necessarily have to be bratton but it goes to city council next week. reporting live in oakland, kristy smith, "today in the bay." >> 5:04. we have a follow up this morning to a story we told you about yesterday. the body found in the trunk outside a car outside of sonoma state university. a medical examiner identified the man as 31-year-old sean

parker. he was found in the back of a car which stood out because it was illegally parked. police won't say how he died. investigators are treating the case as a homicide. parker was wanted for questioning stemming from a domestic violence case with a former girlfriend. a possible link between parker's death and the assault is being investigated. >> opening arguments begin this morning for a suspect charged in a deadly south bay shooting rampage. jing wu facing charges for killing three former co-workers at sy ports in santa clara in 2008. prosecutors allege wu shot and killed the company's ceo and two managers just hours after he was fired. wu could face the death penalty if found guilty. the man accused of tossing bricks into a crowd of people during an occupy protest last year will be in court.

34-year-old justin nesbitt charged with five felonies including assault with a deadly weapon and assault on a police officer. one of those bricks hit a protester in the face. a judge ordering nesbitt to stand trial for a pretrial conference. >> brown is challenging uc and cal state systems saying universities must reconfigure themselves to be effective. but do so in a way to keep costs from going up. the meeting will include a discussion of online learning at the university. just yesterday the governor announced a new program being introduced as san jose state to make online courses more available to students in the hopes of lowering the costs of college and helping students graduate sooner. >> 5:06 now. is it just me or was it hot out today? two degrees warmer. >> definitely. >> heat wave. >> radiating all the way to the

weather wall. good morning to you. things are a touch warmer this morning. it's still downright cold out there. one thing we are noticing, we have patchy fog developing in addition to the patchy frost. that's an indication of more moisture content. it won't be as dry today. 28 degrees in gilroy. 33 in san jose. one away from freezing in sunny vail. 39 in oak town. temperatures will drop throughout the morning, but through filtered sunshine we'll see highs in the 60s. it will be the warmest day of the week so far. we'll head through thursday. four to six degrees warmer. into the weekend the warm-up continues. one city in the bay area potentially hitting 75 degrees by sunday. i'll tell you which one coming up. or you can guess in the meantime. 62 degrees in santa cruz. mike, it's rather light out this

cars below sending people running in every direction. >> there were a lot of people running about. it was manic at the time. i didn't know what was going on. everyone was in shock running around. it was madness. >> officials say four other people on the ground at the time of the crash were hurt. metro police say the crash doesn't appear to be terrorism related. the exact cause remains under investigation. they bill it as the future of air travel but the boeing 787 dream liner has been grounded leaving some scrambling to find flightses. we have more details on what's wrong. a long list of things with the dreamliner. bob, good morning. >> reporter: good morning. all nipon and japan airways have grounded their boeing 787

dreamliner aircraft for safety inspections. that means this morning's flight between normanetta and tokyo have been cancelled. this was less than a week after the route went into service with much fanfare and hope for the south bay economy. here's what prompted the latest grounding yesterday. the only grounding so far. yesterday one of the 787 dream liners had to make an emergency landing in japan after a cockpit message warned of a battery problem. a japanese tv crew was on board, captured the evacuation which appeared to go smoothly. japan's transport ministry says this was a serious incident that could have resulted in an accident. in an e-mail to blumberg news boeing is aware of what happened and is working with customers. here in the united states there have been other problems including a battery fire and fuel leak which prompted the faa to review a safety review of all

787 aircraft. on friday, normanetta joined truck reid and the u.s. ambassador to japan to celebrate the launch of ana direct dreamliner service to tokyo. the first time this airport has had it in years. this new route could inject more than $70 million annually into the economy once the route starts up. it's not clear how long ana will keep the dreamliner grounded. bob riddle, "today in the bay." >> thank you. it's 5:14. a congresswoman wants to change hacking lawses after the suicide death of a popular internet activist. the suicide of aaron schwartz has people debating what's right and what's wrong. >> as we mentioned in the past you could never point to a single cause for a suicide.

democratic congresswoman zoe lockran said it's time to update laws. a good number of people say they took advantage of poorly written or old laws to prosecute swartz for downloading academic papers without permission from a publically open network. the idea was opposed to change the law on reddit, the internet forum swartz helped create. initially he faced more than 40 years in jail but it was reduced to six months. the woman prosecuting him, carmen or advertise has become the target of criticism. so much so her husband, an ibm executive, has gone to twitter to fight back criticizing the swartz family on the day of the young man's funeral saying, truly incredible in their own son's obit they blame others for his death. while turning to financial news

let's go to seema mody this morning at cnbc world headquarters. good morning. >> good morning. our top story, the treasury department is temporarily tapping government workers' retirement funds to avoid hitting the debt ceiling. treasury said the move would give it $156 billion in additional spending capacity and insist that retirees will receive benefits. in a letter to john boehner, treasury secretary tim geithner said the step has been taken before during previous impasses over the debt limit. several republican lawmakers are set to direct treasury to prioritize which bills to pay if congress doesn't raise the debt ceiling. let's get you a check on the markets. futures are lower as we get big earnings this morning from jp morgan and goldman sachs. we have jpmorgan lower whereas goldman sachs is higher. stocks advanced yesterday with the dow extending the winning streak to five days and the s&p 500 hitting a five-year high.

extra help but no to bill bratton, the controversial figure at the center of the consultant contract. kristy smith is live at oakland headquarters with more on the growing story. good morning. >> reporter: good morning, john. this consultant that oakland is considering has a really big and impressive resumé. he's credited with bringing down crime in big cities like new york. it's some of his methods that have people concerned and upset here in oakland. saying they will cause more distrust between the community and police. hundreds of people packed into a public safety committee meeting last night and booed and heckled oakland's police chief howard jordan. they stopped him from explaining why he supports spending $250,000 to hire former police chief bill bratton to offer advice on how to stop violent crime in oakland. opponents say bratton won't improve oakland's violent crime rate but will rely on policies

like stop and frisk which they say leads to racial profiling. >> it's up to me to implement bill bratton's advice. it's on my shoulders if and how i do it. >> reporter: many people in the group supported bratton but they were hard to hear over the noise. chief jordan said he support it is plan to hire bratton but said he won't support a plan to put civil liberties or public trust in jeopardy. they support using outside help. doesn't have to be bratton but the city council has to decide what to do. they will consider it next week. live in oakland, kristy smith, "today in the bay." >> seemingly this is the right man for the job for a few months. san jose's interim police chief working on his number one priority. >> as i'm doing now, really to update and talk to the rank and file and let them know about

myself and who i am and that i'm committed. i'm here to represent that. >> larry is a 27-year veteran of the san jose police force. the police union hopes his experience will boost morale in a department hit hard by cut-backs and rising crime. he's not oh interested in taking over full time. current chief chris moore will retire friday. >> the small community of gault mourning the death of an officer killed in the line of duty. a man who was well known right here in the bay area. gault is about 30 miles south of sacrament on highway 99. the suspect killed himself. than is a three and a half year veteran of the police department. this is the department's first on duty casualty since it was

formed. the 35-year-old worked with his canine partner, a dog named yaro. they served in northern california and in the bay area. than seen here at local events often raising money for police dogs including getting them bullet proof vests. >> 5:34. police will question a mother later today about a brazen kidnapping attempt in the family's front yard. officers say a man tried to take her little girl out of her arms. marla spoke with police and has new details on the case. she joins us with more on the investigation. good morning. >> reporter: good morning. a couple of things surprised me about this case. this didn't happen late at night. it didn't happen in a secluded area. in fact it happened in this tight knit cul-de-sac. southeast san jose. now this is the home where it happened.

i believe alan will zoom in to show you the house. the man happened to walk by this home when they say a 2-year-old little girl was playing in her own front yard. it happened around 5:30 yesterday evening. when the man walked by he made an inappropriate comment. police will not expand on what the man said exactly. whatever it is they say it made the mother who was witnessing the whole thing very uncomfortable. she scooped up her little girl into her arms. that didn't stop the guy. he tried wrestling the girl away but the mother put up a good fight and did what she had to do until the man gave up and ran away. >> it's amazing. a mother's love for her children, any parent. for her to deal with this. again to just be unwaivering and hold on for dear life. for somebody you care about. you have to commend her. >> reporter: officer morales said he's concerned the suspect is on the run this morning,

getting closer to making an arrest in a brazen robbery in which a dog wound up killed. police identified 35-year-old maurice barrett as a suspect in the case. police say he robbed a woman last month as she got out of her car. grarts say he grabbed her 12-year-old dog named rorks are oxy and threw the dog into traffic. roxy died at an animal hospital. if you know anything about barrett's whereabouts call san francisco police. >> 5:37 now. want to get you updated on the forecast with christina loren. a little bit warmer. i don't know if you can feel it. >> i didn't have my window down driving to work. >> i had a blanket on. look at that, 28 in gilroy. >> why do you need the windows down when you drive a convertible, john? just kidding. not telling you what he drives t. ladies would be chasing him around town. 35 degrees in santa cruz. speaking of which, you have less

tracie potts joins us live on capitol hill with more on what the president is expected to say and the opposition he's facing. good morning, tracy. >> reporter: good morning. in response to new york's new law the nra says tougher laws on guns won't work. they are the same types of laws we expect the president to pitch in a few hours when he rolls out his new plan to control gun violence in this country. among those things he's expected to talk about -- an assault weapons ban and a ban on high capacity magazine clips. congress would have to approve both. then there is a list of 19 different areas he can address through executive order without dealing with it at all. that came from vice president biden's group. from that list some of the things he's expected to talk about today are universal background checks. in other words you get a background check whether you buy the gun online, at a gun show or a retail store, even from a private party. mental help, money for school security all expected on the

president's agenda when he makes the announcement this morning. >> all right. thank you for that. something we'll continue to follow. it's 5:43 now. in the meantime, police in marin county collected more than 800 guns during buyback programs yesterday. people from san francisco, and sonoma counties surrendered 827 guns. organizers say each person received 100 to 200 dollars per firearm. the weapons were collected. no questions asked meaning police didn't investigate anyone turning in a gun. a second buyback event will be held next monday on martin luther king day in mill valley. >> all boeing 787 dreamliner flights headed to japan have been cancelled following a list of recent mechanical problems. that, of course, is affecting business in san jose airports. the bay area's only hub for plane. bob is live at the airport now with details on the multiple things dragging down the

dreamliner. bob, good morning. >> reporter: good morning, john. friday all nipon airlines was celebrating direct service between normanetta and tok yochlt the flight was in the first week of service. it's now cancelled because japan air license and all nipon airlines has grounded voluntarily all 787 dream liners for safety inspection. it was an incident that took place yesterday with one of ana's dream liners. had to make an emergency landing in japan. there was a battery warning light that came on. you can see the japanese tv crew was on board the flight. they captured the evacuation which appeared to go oh smoothly, no one hurt. the transport ministry in japan said it was a serious incident that could have resulted in an accident clearly that didn't happen. the plane landed safely. boeing airlines, the aircraft

company did send an e-mail to bloomberg saying they are aware of what happened and are working with their customer. of course being all nipon airlines. it was on friday we mentioned norm anetta joined chuck reid along with united states ambassador to japan to celebrate the launch of the direct service to tokyo. this is the first time norm manetta international had nonstop service to japan in several years. it was back, i believe, in 2006 or 2007 at american airlines was running the route. the silicon valley leadership group estimates the new route could inject more than $70 million annually into the south bay economy. of course again today the flight is cancelled. it's not clear when it will be restarting up. we imagine once ana gets through voluntary inspections of the 787s. bob ridell, today in the bay. >> very interesting. we have been talking about the

>> how many of your friends are 49ers fans? soon you can find out with a simple search. people waiting for facebook's new feature they are introducing. >> no doubt everybody's heard about it by now. you won't be able to get it on facebook for several weeks. this graph search. facebook will put a privacy reminder asking you to double check your settings because friend lbs searching for details about you. let me give you an example. a friend coming from mexico. you will take them to yosemite but you want to make it a party. say, show me my friends who live in the bay area who speak spanish and like to go to yosemite. or a tv watching party. list my friends who live near me who love "game of thrones." or what indian restaurants do my friends from india like? that will give you good results.

one thing that happened after that was shares in yelp fell big. better than 7%. the facebook officials started to show some of the restaurant reviews. i personally don't think yelp or google is particularly threatened by this. i think you will do different searches based on different things. after all, only a certain number of my friends have been to a particular restaurant but y e elp will have hundreds of reviews. it will be very powerful. people will be concerned about privacy. but remember, what you put on facebook is what's searchable. if you said you went to st. mary's, i can search it out. if you didn't mention it, you won't show up in the search. >> is it based on the past status updates? >> yes. likes. where you're from. who you are related to. your marital status. that kind of thing. show me my married friends who live in, whatever. anything publically available. yes.
